Kuwait Housing & Tenancy Law: Lease Contracts, Rent Circuit Courts & Eviction Protections

Supervisory Judiciary: Rent Circuit Court (Court of First Instance)  |  Supervisory Ministry: Ministry of Justice (MOJ)  |  Governing Statute: Decree-Law No. 35 of 1978 (The Lease Law), amended by Decree-Law No. 95 of 2024

Residential and commercial leasing in the State of Kuwait is anchored on Decree-Law No. 35 of 1978 (The Real Estate Lease Law), modernized by landmark legislative reforms enacted under Decree-Law No. 95 of 2024. Kuwaiti tenancy jurisprudence enforces a strict statutory equilibrium between protecting occupants against unlawful eviction or arbitrary rent hikes and safeguarding property owners’ capital investments. With the operationalization of notarized Executive Lease Contracts under Article 11 Bis, rental agreements executed under the executive formula carry the direct legal enforceability of an execution writ, fundamentally reforming how rent disputes, defaults, and eviction petitions are adjudicated across all governorates.

Tenancy Dimension Statutory Provision & Procedural Standard
Statutory Rent Increase Lock Rent is strictly locked for 5 consecutive years from the lease commencement date; landlords cannot impose mid-term rent hikes without written mutual consent or a formal Rent Court re-evaluation ruling
Executive Lease Formula (Article 11 Bis) Leases notarized under Law No. 10 of 2020 bearing an executive formula function as enforceable judicial writs, allowing landlords to recover unpaid rent via the Execution Department without protracted court trials
Rent Default & Eviction Notice Window Rent must be paid by the contractual due date (or within the statutory 20-day grace window following formal legal notification); failure to pay or deposit in court permits summary eviction
Court Rent Deposit Mechanism If a landlord refuses to accept payment or issue an official receipt, the tenant must deposit the rental funds directly at the Ministry of Justice Rent Treasury to legally invalidate default claims
PACI Civil Address Registration An authenticated tenancy contract and the building’s automated PACI Civil Number are statutory prerequisites for updating Civil ID addresses and processing family visas

1. Contractual Form, Registration & The Executive Formula

Under Kuwaiti law, lease agreements for residential premises must be formalized in writing and executed in Arabic (or bilingual format where the Arabic text retains governing legal supremacy). Under the legislative overhaul of Decree-Law No. 95 of 2024, the contract structure operates under modernized enforcement mandates:

Executive Lease Framework (Article 11 Bis)

  • • Mandatory Notarization: Contracts stamped by the Documentation Department of the Ministry of Justice with the statutory executive formula (Al-Sighah Al-Tanfeeziyah) hold the evidentiary weight of final court execution deeds.
  • • Expedited Debt Collection: If rent falls into arrears, the lessor does not need to file a full substantive lawsuit; the execution formula allows direct asset garnishment and bank holds through the Execution Directorate once formal legal notice expires.
  • • Eviction Acceleration: The revised framework prevents protracted litigation tactics; appeals against Rent Circuit rulings are expedited before the Court of First Instance in its appellate capacity, eliminating former appellate backlogs.
  • • Survival of Lease on Ownership Transfer: If a residential building is sold, the tenancy contract survives intact by operation of law; the new landlord inherits all obligations and cannot terminate the existing tenancy or demand new lease terms prior to contract expiration.

2. Statutory Eviction Grounds & Court Rent Deposits

Landlords in Kuwait cannot terminate leases or evict tenants arbitrarily outside the statutory circumstances established by Article 20 of Decree-Law No. 35 of 1978:

Eviction Ground Legal Conditions & Evidentiary Requirements Tenant Protection Mechanism
Non-Payment of Rent Rent is overdue and remains unpaid 20 days after receipt of an official notification via court bailiff or registered mail. Repeated failure to pay can result in eviction even if paid before judgment. Deposit full rental arrears into the Ministry of Justice Rent Treasury within the 20-day notice window
Unauthorized Subletting The tenant assigns the lease, subleases the apartment, or vacates the premises in favor of third parties without explicit written authorization from the landlord. Written addendum or consent clause in the signed tenancy agreement
Structural Demolition or Rebuilding The building is aged (typically 25+ years) and the landlord holds approved Kuwait Municipality demolition/reconstruction licensing, giving at least 6 months’ notice. Statutory compensation and priority right to re-lease once reconstruction completes
Personal Necessity (Housing Need) The landlord proves urgent personal need to occupy the unit for themselves or their immediate family, possessing no other suitable residential asset. Strict judicial burden of proof; if the landlord re-leases to a stranger, tenant can claim heavy damages

3. Maintenance Responsibilities, Security Deposits & Rent Court

The law establishes strict divisions of property maintenance liability and settlement protocols for rental disputes:

  • Structural vs. Usufruct Maintenance: The landlord is legally mandated to perform major restorations essential for property preservation and basic utility (roof leaks, central HVAC systems, elevators, structural plumbing, and external electrical lines). Minor consumable repairs (internal light fittings, internal lock repairs, minor leaks within the flat) are tenant responsibilities.
  • Right of Deductive Repair: If a landlord neglects critical structural maintenance after formal written notice, the tenant may obtain Rent Court permission (or execute emergency repairs with certified invoices) and legally deduct the certified costs directly from upcoming rent payments.
  • Security Deposit Recovery: Security deposits (typically 1 month’s rent) held by the landlord must be refunded upon handover of the premises. Deductions are only lawful for substantiated damage beyond normal wear and tear or unpaid utility bills.
  • Rent Dispute Circuit Filing: Rental disputes are adjudicated exclusively by specialized Rent Circuits (Dawa’ir Al-Ijarat) within the Court of First Instance in the governorate where the real estate is located. Legal proceedings require presentation of the original lease contract, Civil ID copies, and proof of all rent deposits.
